29 CFR 1910.106(f)(6): Sources of ignition. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be handled, drawn, or dispensed where flammable vapors may reach a source of ignition. Smoking shall be prohibited except in designated localities. "No Smoking" signs shall be conspicuously posted where hazard from flammable liquid vapors is normally present.  (a) Shop Area, On or about February 14, 2017 and times prior, the employer exposed employees to fire hazards in that the wooden flammables storage cabinet was not clearly marked with a "No Smoking" sign. Employees used chemicals such as, but not limited to: goof off and paint thinner.

29 CFR 1910.106(d)(3)(ii)(b): Wooden cabinets constructed in the following manner shall be deemed in compliance. The bottom, sides, and top shall be constructed of an approved grade of plywood at least 1 inch in thickness, which shall not break down or delaminate under fire conditions. All joints shall be rabbetted and shall be fastened in two directions with flathead woodscrews. When more than one door is used, there shall be a rabbetted overlap of not less than 1 inch. Hinges shall be mounted in such a manner as not to lose their holding capacity due to loosening or burning out of the screws when subjected to the fire test.  (a) Shop Area, On or about February 14, 2017 and times prior, the employer exposed employees to a fire hazard in that flammable liquids were stored in a wooden cabinet that was approximately 3/4 inch thick and not rabbeted at the joints.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) Shop Area, On or about February 14, 2017 and times prior, the employer exposed employees to skin & respiratory irritation hazards in that a written hazard communication program was not provided to them while using chemicals such as but not limited to degreasers, paint thinners and primers.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  (a) Outside the shop area, on or about February 14, 2017 and times prior, the employer exposed employees to airborne hazards in that employees were permitted voluntary use of respirators and not provided with information contained in appendix D while performing spray painting operations with recreational vehicles.

29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  (a) Outside the shop area, on or about February 14, 2017 and times prior, the employer exposed employees to airborne hazards in that the employer did not ensure that employees were medically able to use a tight fitting respirator while they were performing spray painting operations on recreational vehicles.
