29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. a) Sterling Industries Inc., employees, working on the 37th and 38th floor at 277 Park Ave. NY, NY installing ductwork; were exposed to the hazards of fire and explosion while working with duct sealant Eco-Duct Seal 44-52 (Hexane, methyl acetate, vinyl acetate). The employer did not provided adequate training on the hazards associated to the sealant, its control and/or elimination. The condition was noted on or about 02/15/17. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.352(c): Welding, cutting, or heating was done where the application of flammable paints, or the presence of other flammable compounds, or heavy dust concentrations created a hazard: a) Sterling Industries Inc., employees, working on the 37th and 38th floor at 277 Park Ave. NY, NY installing ductwork; were exposed to the hazards of fire and explosion while working with the flammable (category 2) duct sealant Eco-Duct Seal 44-52 (Hexane, methyl acetate, vinyl acetate). The employee grind cut the ductwork creating a spark that ignited the vapors of the sealant creating a flash fire that injured the employee with second degree burns to the face and torso. The condition was noted at or around 02/15/17. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
