29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about February 15, 2017 at or near 11 Bouriese Circle, Maumelle, AR 72113, the employer exposed employees to fall from height hazards while mounting and dismounting ladders that were only extended approximately 1.5 feet above the upper landing surface to a 10/12 pitched roof they were roofing.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about February 15, 2017 at or near 11 Bouriese Circle, Maumelle, AR 72113, the employer exposed employees working at approximately 18 feet above lower levels to fall from height hazards. Employees were working on a 10/12 pitched roof without any type of fall protection. The Jose Malagon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1076245, citation number 1, item number 1 and was affirmed as a final order on July 23, 2015, with respect to a workplace located at 20555 E. Girard Place, Aurora, CO 80013.
