.29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through(o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   Location:  114 Porter Street, Waterbury, CT  06723     An effective hearing conversation program was not administrated where by an employee sustained standard threshold shifts as documented on the 2016 OSHA 300 log.  An employee was exposed to noise levels above the time weighted average (TWA) of 85dBA.  On the first shift, a maintenance operator exposed to continuous noise at 97.9% of the permissible daily noise exposure 8.5 hour time-weighted average sound level of 90 dBA or an equivalent sound level of approximately 89.1 dBA during the 511 minute sampling period on 02/24/16.

29 CFR 1910.95(i)(3): Employees were not given the opportunity to select their hearing protectors from a variety of suitable hearing protectors provided by the employer:   Location:  114 Porter Street, Waterbury, CT  06723   Only one choice of hearing protection was made available to employees where hearing protection was required.  On the first shift a maintenance operator exposed to continuous noise at 97.9% of the permissible daily noise exposure 8.5 hour time-weighted average sound level of 90 dBA or an equivalent sound level of approximately 89.1 dBA during the 511 minute sampling period on 02/24/16.

Information in the training program was not updated to be consistent with changes in protective equipment and work processes:  Location:  114 Porter Street, Waterbury, CT  06723  Each employee was not trained annually where exposed to noise levels above the time weighted average (TWA) of 85 dBA.   On the first shift a maintenance operator exposed to continuous noise at 97.9% of the permissible daily noise exposure 8.5 hour time-weighted average sound level of 90 dBA or an equivalent sound level of approximately 89.1 dBA during the 511 minute sampling period on 02/24/16.
