OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that that a laborer was protected from the hazard of falling. An employee was standing on the second to the top step of a Werner 12 foot ladder while trying to access a 3rd level box conveyor. The ladder was not high enough for the employee to access the upper landing surface without using one the top two steps which is prohibited. This most recently occurred on or about February 14, 2017 at 1500 Plum Creek Parkway, Lexington, NE 68850 in New Box Storage.
