29 CFR 1910.1200(e)(1) is applicable to shipyard employment by 29 CFR 1915.1200 that incorporates the General Industry requirement: The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    Location: Boat yard and/or onboard M/V Catalina Spirit    The written Hazard Communication Program does not include information on labeling, maintenance of safety data sheets, and training for employees who work with hazardous chemicals. Employees were working with products, such as but not limited to paints, varnishes, and degreasers when performing ship repair activities.

29 CFR 1915.74(a)(1): The employer permitted employees to board or leave a vessel by using a gangway with less than 20 inches walking surface, of adequate strength, maintained in safe repair, and safely secured.    Location: M/V Catalina Spirit    A gangway was not provided for employees to use for access to and egress from the boat during ship repair activities. Employees had to step across a 19-inch opening over the water to gain access to the boat, exposing them to fall and drowning hazards.

29 CFR 1915.77(e): When employees were boarding, leaving, or working from small boats or floats, they were not protected by personal flotation devices meeting the requirements of 29 CFR 1915.158(a).    Location: M/V Catalina Spirit    Personal floatation devices (PFDs) were not used by employees performing painting operations on the exterior of the boat. Employees were working on floating platforms and from the mobile staircase and were at risk of falling into the water and drowning.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:  Location: M/V Catalina Spirit  Employees were not fit tested for N-95 filtering facepiece respirators which were required when performing sanding operations onboard the vessel. Employees were exposed to respiratory irritation from particulates.

29 CFR 1915.72(a)(6): Manufactured portable wood ladders provided by the employer were not built or used in accordance with the provisions of the American National Standards Institute Safety Code for Portable Wood Ladders, A14.1-1975.  Location: M/V Catalina Spirit  Employees were using a painted Werner wooden ladder on the bow of the vessel to perform prepping and painting operations, which is not in accordance with manufacturer's safety instructions.
