29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  (a) New residential construction, East gable side: On or about 02/16/2017, and at times prior, the employer exposed employees to fall hazards of over 25 feet from a pump jack scaffold platform, in that a fall protection system was not provided to an employee painting the rake boards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  New residential construction, roof: On or about 02/16/2017, and at times prior, the employer exposed employees to fall hazards of 20-feet from the roof to the lower level , in that a fall protection system was not provided while using the roof to access the pump jack scaffold system.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a) New residential construction on Lot #144, East gable side: Employee exposed to fall hazards of over 25-feet was not trained by a competent person to recognize hazards associated with the pump jack scaffold system used to paint the rake boards.
