29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided: At the jobsite located at 415 W 4th in Hays, Kansas, an employee engaged in framing a multi-family dwelling with the use of a pneumatic nail gun was exposed to stuck by hazards. The employee was exposed in that eye protection was not in use to prevent an eye injury.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms where the entire platform was not attached to the fork. Employees at a residential construction job at 415 W 4th in Hays, Kansas were exposed to fall hazards of 10 feet or more. An employee was applying siding from a work platform positioned on the forks of the GEHL 663 telehandler. Employee were exposed to an eighteen (18) foot fall in that the 5' by 12' work platform was not secured to the mast or forks of the telehandler.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. Employees at a residential construction job at 415 W 4th in Hays, Kansas were exposed to fall hazards of 10 feet or more. Employees applying siding from a work platform positioned on the forks of the GEHL Model 663 telehandler and were not protected from falling in that the work platform did not have guardrails.
