29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Spartan Contractors Incorporated did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling and other forms of warning; 2) Safety data sheet availability; 3) Employee information and training; 4) A list of hazardous chemicals known to be present in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to provide other employer(s) access to safety data sheet; information on any precautionary measures and the labeling system used in the workplace.  On or about February 16, 2017, five employees were exposed to a hazardous chemical, crystalline silica, while performing demolition activities on the seventh floor of the building located at 55 E. Washington St. Chicago, IL 60602.  Crystalline silica was a component of the red brick and mortar being demolished at the worksite.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  a) On or about February 16, 2017, Spartan Contractors Incorporated did not ensure that a Safety Data Sheet (SDS) for each hazardous chemical that employees were exposed to was available in the workplace. The employer did not have a SDS for crystalline silica, a component of the red brick and mortar being demolished at the worksite. Five employees were exposed to crystalline silica while performing demolition activities on the seventh floor of the building located at 55 E. Washington St. Chicago, IL 6062.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On or about February 16, 2017, Spartan Contractors Incorporated did not provide information and training to employees exposed to a hazardous chemical, crystalline silica, which was a component of the red brick and mortar being demolished at the worksite.   (b) On or about February 16, 2017, Spartan Contractors Incorporated did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103):  a) On February 16, 2017, employees were not provided with the information contained in Appendix D to 29 CFR 1910.134 when voluntary respirator use was permissible.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
