OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards while handling pyrophoric trimethylindium (TMI) in the presence of oxygen and/or water: a) Pod 5, EPI - on or about February 16, 2017, employees were changing feed cylinders (bubblers) containing pyrophoric TMI, in the presence of air and/or water, when a fire and explosion occurred. Three employees were injured; one requiring hospitalization. One feasible and acceptable means of abatement, among other, is to follow the manufacturer's Safety Data Sheet for TMI which includes handling under inert gas and preventing contact with air or water.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Pod 5, EPI - on or about February 16, 2017, the employer failed to provide and ensure the use of flame-retardant treated clothing (FRC) necessary to protect employees from burns when changing out the TMI bubbler on the OE reactor.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: a) Pod 5, EPI - on or about February 16, 2017, an employee performing trimethylindium bubbler change out on the OE reactor had not been provided training on the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used.
