29 CFR 1910.29(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds applied in a downward or outward direction within 2 inches (5 cm) of the top edge, at any point along the top rail: (a) The guardrail post atop of the Storage Tank was wobbly. Distance from the platform atop the tank to the floor was 8 feet. This condition exposed workers to an 8 foot fall hazard.

29 CFR 1910.29(b)(13)(i): Guardrail opening that serves as a point of access did not have a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section; or is offset to prevent an employee from walking or falling into the hole opening. (a) Fixed Ladderway floor opening on the platform adjacent to the 3rd dip tank was not guarded by a swinging gate or offset so that a person could not walk directly into the opening. This exposed employees to a fall hazard of six (6) feet.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) Training did not include adequate explanation of the labels on shipped containers. Information was not provided regarding the meaning of pictograms, signal words ("Warning" or "Danger), hazard statements, and precautionary statements. Hazardous chemicals used at this work site included, but were not limited to: Xpelair MR, Novacide AKD 3016, and Sulphuric Acid (small quantities). (b) Training did not include explanation of workplace labeling that the employer uses on secondary containers which are used for more than one shift and by more than one worker. (c) Training did not include an explanation of the safety data sheet (SDS), including the order of information.
