29 CFR 1904.40(a):  When an authorized government representative asks for the records you keep under Part 1904, you must provide copies of the records within four (4) business hours:   a. Record-keeping - On or about March 06, 2017 at approximately 0845, a document request was issued to employer specifying OSHA record-keeping documents within five working days (Due no later than the close of business on March 14, 2018). This request was answered on March, 22, 2016.   b. Record-keeping - On or about March 06, 2017 at approximately 1100 records were requested during telephonic conference for the referenced inspection. Documents were not provided in accordance with OSHA requirements.  This request was answered on July 20, 2017.   There is no abatement certification of documentation required for this item.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a. On or about February 17, 2017, employees engaged in construction activity at the above referenced worksite were required to operate a scissor lift in the performance of their assigned duties. The employer failed to provide workers with a site specific safety plan that included at a minimum, a mandate for frequent and regular inspection of any and all equipment used by the employees at the worksite, and made / conducted by a competent person as designated by the employer. This plan also requires a provision / method for reporting any equipment defects or maintenance needs.    b. On or about February 17, 2017, employees engaged in construction activity at the above referenced worksite were required to operate a scissor lift in the performance of their assigned duties. The employer failed to ensure that employees inspected the area where the scissor lift was to be operated, to ensure the operating surface would sustain the weight of the lift, and was free of all obstructions.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.454(a)(3): The employer did not train each employee who performs work on a scaffold, by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, including the proper use of the scaffold and the proper handling of materials on the scaffold:  a. On or about February 17, 2017, employees engaged in construction activity at the above referenced worksite were required to operate a scissor lift in the performance of their assigned duties. The employer failed to provide workers training on hazards, including how to work safely with or near scissor lifts in accordance with this OSHA standard. Employees became stranded in a scissors lift on the worksite and were unaware of the location of the equipment's manufacturers instructions for operating the scissor lift vertically and / or emergency procedures for lowering the unit.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
