29 CFR 1926.502(k)(1): The fall protection plan shall be prepared by a qualified person and developed specifically for the site where the leading edge work, precast concrete work, or residential construction work is being performed and the plan must be maintained up to date. On or about February 16, 2017, during the construction of a concrete foundation near 2131 West 10th Street, Cleveland, Ohio, the employer did mot develop the fall protection plan specifically for the site where the construction work was being performed.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. On or about February 16, 2017, during the construction of a residential foundation at approximately 2131 West 10th Street, Cleveland, Ohio, the employer did not ensure employees climbing the face of concrete formwork to access the top of the formwork or area inside the foundation were provided with a stairway or ladder where there was a break in elevation greater than 19 inches.
