29 CFR 1910.178(a)(4):  Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval.  Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:     a.  On or before February 16, 2017, the employer did not ensure that the job made platform attached to the Caterpillar forklift (model: EX5000; S/N: A4EC320327) had the manufacturer's written approval for use such as lifting employees, thereby exposing employees to a fall hazard.  An employee injury occurred on or about February 9, 2017, when the unapproved platform attached to the forks of the Caterpillar forklift broke and fell over causing the employee and platform to fall approximately 3.5 to 4 feet to the concrete floor below.

29 CFR 1910.178(l)(4)(ii):  Refresher training in relevant topics shall be provided to the operator when:    29 CFR 1910.178(l)(4)(ii)(B):  The operator has been involved in an accident or near-miss incident:    a.  On or before February 16, 2017, the employer had not provided powered industrial truck refresher training including an evaluation for the operator involved in an accident on or about February 9, 2017, when the unapproved platform attached to the forks of the Caterpillar forklift (model: EX5000; S/N: A4EC320327) broke and fell over causing the employee and platform to fall approximately 3.5 to 4 feet to the concrete floor below.

29 CFR 1910.132(d)(2):  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:   a. On or before February 16, 2017, the employer did not verify that the personal protective equipment hazard assessment had been performed through a written certification for workplace hazards.

The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  a.  On or before February 16, 2017, the employer did not have a completed certification certifying that each powered industrial truck operator had been trained and evaluated as required by this paragraph (l).
