29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Worksite: 135 Dune Rd., Quogue NY: Employees were accessing a ladder Jack scaffold approximately 16 ft. above the ground. The portable ladder was not extended 36 in. above the surface landing; on or about 2/17/17. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

Quogue, NY: An employee installing metal roof from a ladder jack scaffold approximately 15 ft. above the ground was not protected from falling; on or about 2/17/17. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19. This employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(i), which was contained in OSHA inspection number 1051387 citation number 1, item number 2, issued on April 10, 2015 and was affirmed as a final order on April 27, 2015, with respect to a workplace located at 164 Dune Rd. Westhampton Beach, NY 11978.
