29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. a. On or about February 16, 2017 one employee was working in a grass area above a retaining wall at the parking lot of the structure and was not protected by any means of Personal Fall Protection, Guardrails or safety nets, exposing him to a fall of 10' 4" to the parking lot below.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a. On or about February 17, 2017, the employer did not notify OSHA of a workplace accident or injury resulting in the in-patient hospitalization of one employee. On or about February 16, 2017 one employee fell from a retaining wall 10 feet into the park lot below and was hospitalized and required surgery for his injuries sustained in the fall.
