29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Right of the building - On or about February 17, 2017 two employees were exposed a fall hazard while riding in a Genie Lift S-40 serial no. JR5139 that was elevated 22 feet 6 inches above asphalt without fall protection. Also this aerial lifts occupancy capacity was exceeded. This aerial lift has maximum occupancy of 2 passengers. There were 3 employees inside the aerial lift.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer shall not be exceeded. (a) Right of the building - On or about February 17, 2017 three employees were exposed a fall hazard while riding in a Genie Lift S-40 serial no. JR5139 due to an exceeded occupancy capacity. This aerial lift has a warning sticker on the front that reads Maximum of 2 Occupants or 500 lbs.
