OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush hazards:  a) At Elberta Farmers Co-Op Feed Warehouse:  On or about February 17, 2017 and at times prior; the employer allowed his employees to operate a powered industrial truck (Forklift) without being restrained, exposing them to struck-by and caught-between hazards.  b)  At Elberta Farmers Co-Op Outside:  On or about February 21, 2017 and at times prior; the employer allowed his employee to operate a powered industrial truck (Telehandler) without being restrained, exposing him to struck-by and caught-between hazards an employee died from injuries due to powered industrial truck accident.

29 CFR 1910.1030(f)(1)(i): The employer did not make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure:  a)  At Elberta Farmers COOP:  On or about February 21, 2017 and at times prior; the employer exposed employees to the potential of being infected with hepatitis B in that employees assisted another employee after an accident where blood was present and the employer failed to offer the employees the hepatitis B vaccination.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:   a)  At Elberta Framers Co-Op: On or about February 21, 2017 and at times prior; the employer exposed employees to chemical hazards to include but not limited to fertilizers and diesel fuel in that employees were not provided the new information and training on the UN Global Harmonized System (GHS) to include Safety Data Sheets (SDS).
