OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a. On or about February 15, 2017, the clamp failed on an approximately six inch diameter by twenty-four inch long stainless vessel that was being pressure tested with CO2 gas at a pressure of approximately 300 psig. The failure of the clamp released the end cap and clamp from the vessel and struck the face of an employee performing the test.

29 CFR 1910.101(b): "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6.   a. Located in the welding area of the workplace: On or about February 15, 2017 and at times prior, employees were leak testing small stainless vessels through a pneumatic pressure test with carbon dioxide gas. The employer did not provide employees with a suitable means to regulate the gas pressure being transferred from the carbon dioxide cylinder to the stainless vessel, thereby exposing employees to a struck by hazard.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.   a. Located in the workplace: On or about February 20, 2016 and at times prior, the employer did not ensure that employees who operate a horizontal band saw manufactured by Industrial Machinery, Model RF-916B, Serial 191123, were protected from unused portions of the cutting blade, thereby exposing employees to an amputation hazard.

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination shall be made available after the employee has received the training required in paragraph (g)(2)(vii)(I) and within 10 working days of initial assignment to all employees who have occupational exposure unless the employee has previously received the complete hepatitis B vaccination series, antibody testing has revealed that the employee is immune, or the vaccine is contraindicated for medical reasons.   a. The employer did not ensure that each employee involved in the cleanup of the blood had been offered a Hepatitis B vaccine.
