29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: (a) The Vertex Companies Inc, at 2301 Blake Street, Denver, CO: On and preceding 2/23/17, The Vertex Companies Inc did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). The employer directed the work of painting and electrical contractors at the worksite. The Vertex Companies Inc did not perform frequent and regular inspections of the worksite. This condition exposed employees of The Vertex Companies Inc, Bear Electric Inc, and Dapper Painting & Wallcovering Inc to illumination, fall, chemical, and flying object hazards.

The employer directed the work of painting and electrical contractors at the worksite. The painting contractor used paints and caulks and stored the materials at the second floor elevator foyer. The employer had not developed a written hazard communication program with regards to labeling and safety data sheets related to hazardous chemicals in their work area, including but not limited to the following: 1. The Sherwin-Williams Company Promar 200 Zero VOC Interior Latex paint; and 2. Latex caulk.

29 CFR 1926.56(a): While work was in progress, construction areas, ramps, runways, corridors, offices, shops and storage areas were not lighted to the minimum illumination intensities listed in table D-3 of this subpart: (a) The Vertex Companies Inc, at 2301 Blake Street, Denver, CO: On 2/23/17, The Vertex Companies Inc did not ensure that while work was in progress, construction areas, ramps, runways, corridors, offices, shops and storage areas were lighted to the minimum illumination intensities listed in table D-3 of this subpart. The employer directed the work of painting and electrical contractors at the worksite. Workers accessed hallways, a stairwell, and a temporary storage area on the second floor elevator foyer. The temporary storage area and hall in the area of the second floor elevator foyer were not provided with at least five foot candles of illumination. This condition potentially exposed workers to tripping hazards.
