29 CFR 1910.1200(e)(1): Employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a)  Dapper Painting & Wallcovering Inc, at 2301 Blake Street, Denver, CO: On and preceding 2/23/17, the employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f) and (g) of this section for labels and other forms of warning, and safety data sheets will be met.  Employees performed painting tasks.  The employer had not developed a written hazard communication program with regards to labeling and safety data sheets related to hazardous chemicals in their work area, including but not limited to the following:    1.  The Sherwin-Williams Company Promar 200 Zero VOC Interior Latex paint; and  2.  Latex caulk.

Employees performed painting tasks.  Employees used paints and caulks and stored the materials at the second floor elevator foyer.  The employer did not have in the workplace copies of safety data sheets for hazardous chemicals in their work area, including but not limited to the following:    1.  The Sherwin-Williams Company Promar 200 Zero VOC Interior Latex paint; and  2.  Latex caulk.

The scaffold was not provided with guardrails, nor was the employee protected from a fall through use of a Personal Fall Arrest System (PFAS).  This condition exposed one employee to an 11.1 foot fall hazard.
