OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection and crushing hazards from operating a powered industrial truck without a seat belt:       (a) On or about February 23, 2017, and at times prior, employees were exposed to ejection and crushing hazards while operating the Hyster model H80XL forklift which was not equipped with a seat belt.  The hazard was exacerbated by cushion tires that showed spalling, chunking, and flat spots, conditions that can lead to unbalanced and bouncy operation of the forklift.
