29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Shop: On 3-8-16  A worker was exposed to an 8 hour time weighted average noise level of  92 dBA, in excess of the 85 dBA action level, while grinding and polishing stone slabs.   b) Shop: on 3-8-17 A worker was exposed to an 8 hour time weighted average noise level of  88 dBA, in excess of the 85 dBA action level while grinding and polishing stone slabs.    A hearing conservation program including monitoring, annual audiograms and noise training was not implemented for exposed workers.

29 CFR 1910.178(l)(1)(ii): 29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Shop: Operators who used the forklift to move stone products, had not completed a forklift training program.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Shop: Hazard communication training was not provided to workers who were exposed to silica dust during stone cutting operations, used glues/solvent chemicals the fabrication process., and used propane to power forklifts.
