29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: a) 3930 Atlanta Hwy., Montgomery, AL; On or about February 23, 2017 and at time prior thereto, the employer exposed employees to head injury hazards in that employees were allowed to work inside an excavation without head protection when there was the potential for the embankment of the excavation to sluff.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): a) 3930 Atlanta Hwy., Montgomery, AL; On or about February 23, 2017 and at times prior thereto, the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a excavation measuring 16 feet 2 inches to 12 feet deep, 46.5 feet to 40 feet wide, and 44 feet to 45 feet in length that was dug in Class B soil with the excavation sloped at angles ranging from 81 to 82.9 degrees. The employer did not protect their employees from the cave-in hazards by utilizing an adequate protective system.
