29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock or burns; were not protected by protective helmets:  (a)  On or about February 22, 2017, and at times prior thereto, two employees observed installing a parking lot light; the apprentice worked out of  the approximately 20 foot elevated aerial lift utilizing small hand tools while the journeyman worked directly underneath and exposed to an overhead hazard.   Note: Abatement certification IS required for this item.

29 CFR 1926.102(a)(3): The employer did not ensure that each affected employee who wears prescription lenses while engaged in operations that involve eye hazards wears eye protection that incorporates the prescription in its design, or wears eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses.  (a)  On or about February 22, 2017, and at times prior thereto, an employee working out of an aerial lift utilizing small hand tools did not have protective safety glasses donned. 29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  (a) On or about February 22, 2017, and at times prior thereto, an employee without a personal fall arrest system was observed working in an aerial lift that was extended approximately 20 feet above ground.    Note (1):  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  Note (2): Abatement certification IS required for this item.
