29 CFR 1926.451(b)(3): Except as provided in paragraphs (b)(3)(i) and (ii) of this section, the front edge of all platforms shall not be more than 14 inches (36 cm) from the face of the work, unless guardrail systems are erected along the front edge and/or personal fall arrest systems are used in accordance with paragraph (g) of this section to protect employees from falling. a. On or about February 21, 2017, at the construction site located at 4229 McCone Ave, Dublin, Ohio, employees used a welded frame scaffold that was positioned approximately 26 inches from the building without protection from falling between the scaffold and the building on the fourth and fifth level of scaffolds. On or about February 21, 2017, an employee fell from the front side of the scaffold at approximately 24 feet in height and landed on a wooden awning over a door entrance that was approximately 11 feet from the ground.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a. The employer failed to report an in-patient hospitalization to OSHA within 24 hours. An injured employee was hospitalized on February 21, 2017 for two days and OSHA was notified on February 23, 2017 by a higher tiered contractor.
