29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Home Chef, Lithonia, GA - The employer did not developed a written hazard communication program for employees adjacent to a work area that was being painted by an outside contractor. Hazardous chemicals in the workplace include, but are not limited to MACROPOXY® 646 Fast Cure Epoxy (Part A & Part B) which contains, titanium dioxide, phenol, xylene, polyamide, and ehtylbenzene, crystalline silica, epoxy polymer, methyl isobutyl ketone, and ammonia (refrigeration). Full time and temporary employees were experiencing symptoms to include, but were not limited to difficulty breathing, scratchy throat, watery eyes, vomiting, headaches, fainting and other respiratory problems while construction contractors were adjacent to employees, on or about February 28, 2016. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) Home Chef, Lithonia, GA - The employer did not provide safety data sheets for employees adjacent to the construction area that was being painted by an outside contractor.
