29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a) Production Area;  On or about July 19, 2017, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to implement a noise monitoring program while providing hearing protection devices to employees exposed to noise levels above the Action Level of 85 dBA while working on the Depositor and Autobake Lines.     Employees using the Hinds-Bock Depositor (Model 20P-08, Serial No 6780) to make cupcakes were exposed to continuous noise at 143.6% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 94.1 dBA during the 390 minute sampling period on July 19, 2017. The exposure calculation included a zero increment for the 90 minutes not sampled.    Employees working at the end of the Autobake Line (no model or serial number) to box muffins were exposed to continuous noise at 79.24% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 89.8 dBA during the 389 minute sampling period on July 19, 2017. The exposure calculation included a zero increment for the 91 minutes not sampled.     Employees working at the middle of the Autobake Line (no model or serial number) to box muffins were exposed to continuous noise at 85.43% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 90.4 dBA during the 387 minute sampling period on July 19, 2017. The exposure calculation included a zero increment for the 93 minutes not sampled.     Employees working at the beginning of the Autobake Line (no model or serial number) to box muffins were exposed to continuous noise at 117.2% of the permissible daily exposure of 85 dBA (time-weighted average) or an equivalent sound level of approximately 92.7 dBA during the 383 minute sampling period on July 19, 2017. The exposure calculation included a zero increment for the 97 minutes not sampled.
