29 CFR 1910.1450(e)(3)(iii): The employer's Chemical Hygiene Plan did not include a requirement that fume hoods and other protective equipment functioned properly and did not include specific measures that would be taken to ensure proper and adequate performance of such equipment: a. On or about March 1, 2017, employees working in the TCLP Laboratory were not protected from chemical splash or burn hazards while using a chemical fume hood that had a broken sash in that the employer did not follow the chemical hygiene program protocol to ensure that the sash of the chemical hood was operable in accordance with the manufacturer's design.
