29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Rockwood Apartments, Route 40, Bear, DE - On or about February 28, 2017, the employer failed to ensure employees engaged in residential construction were protected from fall hazards in that, employees of a subcontractor were observed working on a residential garage, approximately 8 feet above grade, without any means of fall protection. b) Rockwood Apartments, Route 40, Bear, DE - On or about February 28, 2017, the employer failed to ensure employees engaged in residential construction were protected from fall hazards in that, employees of a subcontractor were observed performing roofing activities, approximately 26 feet above grade and higher, without any means of fall protection. c) Rockwood Apartments, Route 40, Bear, DE - On or about February 28, 2017, the employer failed to ensure employees engaged in residential construction were protected from fall hazards in that, employees of a subcontractor were observed working on unprotected second and third level balconies, at heights between approximately 9 feet and 18 feet above grade, without any means of fall protection.
