OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards while using automotive lifts: (a) On or about March 2, 2017, and at times prior, the employer did not ensure that employees were safe from crushing and struck-by hazards while using wood blocks on the following auto lifts: (1) Hunter Alignment Machine, in Bay 4 of the Service Department. The wood blocks are used when the lifting arms do not lift high enough for the work that needs to be performed. (2) The Tire Chief Lift in Speed Lane Bay 1. The wood block is used to help balance long vehicles. (b) On or about March 2, 2017, and at times prior, the employer did not ensure employees were safe from crushing and struck-by hazards when riding in automobiles as they were lifted by the two-post Challenger Lift in the Speed Lane Bay 2, and then exiting the raised vehicle. (c) On or about March 2, 2017, and at times prior, the employer did not ensure employees were safe while using the Hunter Alignment Machine, in Bay 4 of the Service Department in that it had not been inspected for 18 months.
