29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:      a. Machine Press # 290 Ton - a machine press operator was exposed to continuous noise dose at 105.7 % of OSHA's permissible action level  (AL) of 50. 0 %, or an equivalent sound level of 90.39 decibels, of the 8-hour time weigted average (TWA) of 85 decibels for the 199 minutes sampled on March 8, 2017. Exposure calculation included a zero (0) increment for the 281 minutes not sampled.     Yet, the employer did not have an effective Hearing Conservation program in effect.
