29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) On or about February 28, 2017; throughout site, employees were not trained by this employer in the recognition and avoidance of unsafe conditions such as but not limited to support/protective system needed in large excavations to prevent a potentially catastrophic failure while working in an excavation   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems   a) On or about February 28, 2017; throughout site, the employer did not have a competent person conduct daily inspections to determine potential hazards that could result in a possible cave-in and determine the support/protective system needed to prevent a catastrophic failure.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) On or about February 28, 2017; south side, employees working in an excavation with vertical walls that were up to 20 feet deep were not protected from cave-in through the use of a support/protective system.  b) On or about February 28, 2017; south side, employees working in a trench with vertical walls that exceeded 5-feet deep, were not sloped or protected by a support/protective system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
