29 CFR 1910.1200(e)(1): Employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a)  Red Deer Ironworks USA, at 1115 16 Road, Fruita, CO 81521: On and preceding 3/3/17, the employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f) and (g) of this section for labels and other forms of warning, and safety data sheets will be met.  Employees performed spray finishing tasks.  The employer had not developed a written hazard communication program with regards to labeling and safety data sheets of  hazardous chemicals in their work area, including but not limited to the following:    1. Gloss Black Enamel (containing tert-butyl acetate and methyl amyl ketone),  2. Acetone, and  3. Xylene.

29 CFR 1910.134(c)(1): The employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations:    (a)  Red Deer Ironworks USA, at 1115 16 Road, Fruita, CO 81521: On and preceding 3/3/17, the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix) of 29 CRF 1910.134, in that employees were required to wear respirators during work operations.  Two employees sprayed Gloss Black Enamel (containing tert-butyl acetate and methyl amyl ketone) on steel pipe in an opened tent.  The employees were required to wear half mask tight fitting air purifying respirators with organic vapor cartridges and pre-filters.  The employer did not have a written respiratory protection program.  This condition potentially exposed the employees to a respiratory hazard.
