The employer did not ensure each employee on a scaffold is protected from falling in accordance 29 CFR part 1926, subpart L. 29 CFR 1926.451(e)(1): Where scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access. Crossbraces shall not be used as a means of access. Site: Front of building at 181 Varick Street, New York, NY 10014 On or about 3/8/2017 a) The employer did not provide a safe means of access to the scaffold platform used by employees, where this platform was more than 2 feet above the point of access.
