29 CFR 1926.304(i)(1): Each circular hand-fed rip saw was not guarded by a hood which completely enclosed that portion of the saw blade above the table and that portion of the saw above the material being cut: a) On or about 3/3/17 at a residential construction site located at 105 E 73rd Street, New York, New York; employees renovating a house were using a Rigid 10' table saw to rip framing lumber. The saw did not have a guard. NO ABATEMENT CERTIFICATION REQUIRED

The panel on the 2nd floor was at 35" to the top and the panel on the 5th floor was at 32" to the top. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge: a) On or about 3/3/17 at a residential construction site located at 105 E 73rd Street, New York, New York; employees renovating a house were using plywood panels as guardrails for the elevator shaft. The panel on the 3rd floor was not fastened and was on the inside of the frame. The panel was not capable of withstanding 200 pounds in this configuration. NO ABATEMENT CERTIFICATION REQUIRED
