29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  a. On or about March 2, 2017, and at times prior, an employee was operating two CAT propane powered forklifts in the yard without completing all the required training. An operational performance evaluation of the employee was not conducted prior to allowing the employee to operate the forklifts, thereby exposing employees to struck by and crushing hazards.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.   a. On or about March 2, 2017, employees were operating a CAT propane powered forklift, model P60000, serial AT13F20842, with a defective backup alarm. The condition of the alarm was present for approximately two weeks and the forklift remained in operation, thereby exposing employees to a struck by hazard.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.   a. On or about March 2, 2017, and throughout two weeks prior, the employer did not ensure that employees inspected the backup alarm on the CAT propane powered forklift model P60000, serial AT13F20842 during the daily forklift inspections. The forklift was in operation with a defective backup alarm for approximately two weeks, thereby exposing employees to a struck by hazard.
