29 CFR 1926.1402(b): The equipment was assembled or used without ensuring that ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer's specifications for adequate support and degree of level of the equipment are met. On or about March 8, 2017, the outrigger of a Zoomillion Crane was set on an uneven sloped surface. This subjected the crane to tipping and/or making the load unbalanced, exposing employees to a struck-by hazard.

29 CFR 1926.1404(h)(2): The size, amount, condition and method of stacking the blocking was not sufficient to sustain the loads and maintain stability. On or about March 8, 2017, the wooden blocking used under the pad of the outrigger to support the Zoomillion Crane was broken, exposing employees to a struck-by hazard.

29 CFR 1926.1424(a)(2)(ii): To prevent employees from entering hazard areas, the employer did not erect and maintain control lines, warning lines, railings or similar barriers to mark the boundaries of the hazard areas and/or did not train each employee to understand what these markings signify. On or about March 8, 2017 and at times prior thereto, the employer did not ensure barriers were provided and maintained around the hazardous area of a crane to prevent employees from walking and/or working within the path of travel, exposing employees to the hazard of struck-by.
