29 CFR 1910.140(c)(12): Anchorages used to attach to personal fall protection equipment must be independent of any anchorage used to suspend employees or platforms on which employees work.  Anchorages used to attach to personal fall protection equipment on mobile work platforms on powered industrial trucks must be attached to an overhead member of the platform, at a point located above and near the center of the platform.      a) Personal fall protection equipment was not positioned and/or attached to an overhead member of the platform to provide an anchorage point for the fall protection equipment (harness and lanyard).

29 CFR 1910.140(c)(18): Personal fall protection systems must be inspected before initial use during each workshift for mildew, wear, damage, and other deterioration, and defective components must be removed from service.      a) Personal fall protection equipment harness and lanyard were not inspected before use, in that the harness was covered with splattered waste material that was being crushed by the shredder.

29 CFR 1910.140(d)(2)(ii) Personal fall arrest systems are rigged in such a manner that the employee cannot free fall more than 6 feet(1.8) or contact a lower level. A free fall may be more than 6 feet(1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more then 6 feet and tested the system to ensure a maximum arresting force of 1800 pounds (8kN) is not exceeded.       a) The employer must ensure that personal fall arrest systems was not rigged or attached in such a manner to prevent a fall in excess of 6 feet due to the location of where it was attached to, length of the fall protection equipment, harness, lanyard and shock absorber.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.    a) Lifting device attachment (man lift) used to elevate the employees to the top of the shredder machine to remove jams were not marked to identify the attachment and/or the weight capacity so that loads were not exceeded.
