29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Employees were exposed to struck by hazards in the warehouse. Employees had not received forklift training. Forklift operators had not received training and been evaluated prior to operating a powered industrial truck.

29 CFR 1910.178(q)(5): Parts of powered industrial trucks requiring replacement were not replaced with parts equivalent in safety with those used in the original design. Employees were exposed to struck by hazards in the warehouse as the Hyster forklift had damaged tires with chunks of rubber missing. The Hyster forklift also had half the seatbelt missing and the back up light was not working. The forklift had not been taken out of service until it was in safe operating condition.
