29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. West side of Building/Grinder Machines Area - a machine grinder operator was exposed to continuous noise dose at 68 % of OSHA's permissible action level (AL) of 50 %, or an equivalent sound level of 87.21 decibels, of the 8-hour time weigted average (TWA) of the 85 decibels for the 305 minutes sampled on April 12, 2017. Exposure calculation included a zero (0) increment for the 175 minutes not sampled. Yet, the employer had not established a hearing conservation program for employees.
