29 CFR 1910.178(p)(1): If at any time a powered industrial vehicle is found to be in need of repair, defective, or in any way unsafe, the vehicle shall be taken out of service until it has been restored to safe operating condition. On or about March 17, 2017, employees were exposed to struck-by hazards when a powered industrial vehicle with a broken horn and emergency brake was being used to complete job tasks. The employer had not removed the powered industrial vehicle from service that was in need of repair. No abatement certification or documentation is required for this item.

29 CFR 1910.178(q)(7): Powered industrial vehicles were not examined before being placed in service. On or about March 17, 2017, employees were exposed to struck-by hazards when powered industrial vehicles were not inspected prior to being placed into service. A powered industrial vehicle used to complete job tasks was identified to have a broken emergency brake and horn. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
