29 CFR 1910.178(p)(1): If at any time a powered industrial vehicle is found to be in need of repair, defective, or in any way unsafe, the vehicle shall be taken out of service until it has been restored to safe operating condition.  On or about March 17, 2017, employees were exposed to struck-by hazards when a powered industrial vehicle with a broken horn and emergency brake was being used to complete job tasks.  The employer had not removed the powered industrial vehicle from service that was in need of repair.    No abatement certification or documentation is required for this item.
