29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user. Jobsite: On or about March 22, 2017 the employer allowed for the voluntary use of elastomeric air purifying respirators (3M 6500 Series) on the jobsite without implementing the necessary elements of a written respiratory protection program such as medical evaluations and inspection, care and maintenance. Employees on the jobsite were not evaluated to be medically qualified to wear a tight fitting respirator while performing demolition work.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function. Jobsite: On or about March 22, 2017 at the jobsite in Providence employees were observed wearing tight fitting respirators (3M 6500 Series and 3M 8200 respirators) on the jobsite with facial hair that came between the sealing surface of the face piece and the face while performing demolition work.
