29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  a) 211 West Front Street, Plainfield NJ: The employer's Bloodborne Pathogens exposure control plan had no reference to input from non-managerial healthcare workers, such as Dental Assistants or Hygienist, on engineering or work practice controls used within the 4 patient exam rooms.  The condition existed on or about 3/21/2017.

29 CFR 1910.1030(d)(4)(iii)(A)(2)(iii): During use, containers for contaminated sharps were not replaced routinely or were allowed to be overfilled:  a) 211 West Front Street, Plainfield NJ: The sharps container in exam room 2 became overfilled and remained in use without being replaced, exposing dental assistants and hygienist to hazard of bloodborne pathogen infection from needlestick during disposal of used needle(s) into sharps container with protruding uncapped sharps.  The condition existed on or about 3/16/2017.

Condition(s) was existed on or about 3/21/2017.
