The employer has not conducted an initial determination to determine if employees may be exposed to lead at or above the action level.

29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:  (a) Radiator Repair Area:  On April 14, 2017 and times prior, the employer did not ensure that all surfaces were maintained as free as practicable of lead.  Wipe samples indicated that the water fountain and radiator repair area had an accumulation of lead.

29 CFR 1910.1025(l)(1)(i): Employee(s) working in an area where there is potential exposure to airborne lead at any level were not informed of the content of Appendices A and B of 29 CFR 1910.1025:  (a) Radiator Repair Area:  On April 14, 2017 and times prior, an employee was exposed to airborne lead fume at an 8-hour Time Weighted Average of 1.0 micrograms per cubic meter of air for the 292 minute sampling period on April 14, 2017 while conducting radiator repair using a lead based soldering wire. The employer did not provide employees with the information on lead contained in Appendix A (Substance Data Sheet for Occupational Exposure to Lead) and Appendix B (Employee Standard Summary) of 29 CFR 1910.1025.

29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) Radiator Repair Area:  On April 14, 2017 and times prior to, employees conduct radiator repair using a lead based solder.  The employer has not developed or implemented a written hazard communication program for employees exposure to the lead.      ABATEMENT NOTE:  A written program shall include a description of how the criteria for the following will be met:  1.        Labeling and other forms of warnings;  2.        Safety Data Sheets;  3.        Employee information and training.      Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and the availability of safety data sheets must also be addressed.  The written program must be made available upon request.
