OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employee, in that employees were exposed to the hazard of being struck and/or hit by falling objects from the overhead under hung hoists: ESTABLISHMENT: The 5-ton R&M Material Handling Inc. and the 10-ton, unknown identification overhead under hung hoists, had the following deficiencies as follow: A. Welding Department: The 5-ton R&M Materials Handling, Inc.: 1. The pendant control was not marked with at the release; up and down buttons. ABATED DURING THE INSPECTION. 2. The pendant control e-stop was missing a button. ABATED DURING THE INSPECTION. B. Machine Shop Department: The 10-ton, unknown identification: The pendant control was not marked for the up and reverse buttons. ABATED DURING THE INSPECTION.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. WORKSHOP: The following powered industrial trucks (PITs) had the following defects: 1. Hyster 40, Model N40XMR3; was not equipped with a back up alarm and/or strobe light. 2. Hyster 50, Model E50XM2-27; was not equipped with a back up alarm and/or strobe light and the front right light was not operable. 3. Hyster 40, Model N40XMR1; was not equipped with a back up alarm and/or strobe light. 4. Mitsubishi, Model FG25B; was not equipped with a back up alarm and/or strobe light. ABATED DURING THE INSPECTION
