29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.   a.  At the work site, employees had fabricated fork extensions for the CAT forklift.  The employer had not ensured that the alterations had been approved by the manufacturer and that the face plate of the fork lift had been changed to show the change in capacity and operation.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.   a.  At the work site, employees used fabricated fork extensions for the CAT forklift that was used to move raw and finished materials at the work site.  The employer had not ensured that the fork lift had been marked to indicate the weight alteration in the fork lift with a laterally centered load at maximum elevation.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    a.  At the work site, employees used a propane CAT fork lift to unload raw materials in the yard, move raw materials into the shop, move finished materials out of the shop, and to load completed projects for delivery. All employees who operated the propane CAT fork lift truck had not completed a training program at the work site.

29 CFR 1910.303(g)(1): Space about electric equipment. Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment.   a.  At the work site located at 2588 Johnstown Road, Columbus, Ohio, on March 27, 2017, the electrical room under the stairs contained a five gallon plastic bucket of rags, a five gallon plastic bucket, a metal box of miscellaneous materials, and a plastic pan that had some residual oil covering the bottom.  All items were located within the three foot area around the electrical panels that was marked by yellow paint as an area to be kept clear.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) shall be visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket). Cord and plug connected equipment and flexible cord sets (extension cords) which remain connected once they are put in place and are not exposed to damage need not be visually inspected until they are relocated.   a.  At the work site located at 2588 Johnstown Road, Columbus, Ohio, on March 27, 2017, an extension cord with damaged exterior insulation at the plug was observed in an employee work station.  The employer had not ensured that all portable cords were visually inspected for defects prior to use and removed if found to be damaged.
