29 CFR 1910.146(d)(3)(iii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including isolating the permit space.    On March 27, 2017, the third party contractor did not utilize the host employer's permit-required confined space and Lock-Out/Tag-Out program procedures and practices necessary for safe permit space entry operations, including isolating the permit space. This condition exposed employees to caught-in and struck-by hazards.

29 CFR 1910.146(f)(8): The entry permit that documented compliance and authorized entry to a permit space did not identify the measures used to isolate the permit space and to eliminate or control permit space hazards before entry.    On March 27, 2017, the employer or his representative did not ensure that the entry permit identified the measures used to isolate the permit space and to eliminate or control permit space hazards such as but not limited to the agitators. This condition exposed employees to caught-in and struck-by hazards.

29 CFR 1910.146(j)(2): The employer did not ensure that each entry supervisor verified, by checking that the appropriate entries had been made on the permit, that all tests specified by the permit had been conducted and that all procedures and equipment are in place before endorsing the permit and allowing entry to begin .    On March 27, 2017, the employer or his representative did not ensure that all procedures and equipment were in place before endorsing the permit and allowing entry to begin. This condition exposed employees to caught-in and struck-by hazards.

29 CFR 1910.146(j)(3): The employer did not ensure that each entry supervisor terminated the entry and canceled the permit as required by 29 CFR 1910.146(e)(5).  On March 27, 2017, each entry supervisor or his representative did not terminate the entry and cancel the permit when other employees other than those listed on the permit made entry.  This condition exposed employees to caught-in and struck-by hazards.
