OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crush-by and struck-by hazards created by unsecured A-frames mounted on trucks: a) Warehouse - On or about 03/28/17 and at times prior thereto employees loaded and transported stone slabs on A-frame mounted on the back of a truck. The employer did not assess the forces acting on the loaded frame to ensure it was safely bolted to the truck. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Warehouse - On or about 03/28/17 and at times prior thereto employees operated the LPG-powered Toyota forklift with a makeshift attachment for free rigging (below-the-tine lift) of stone slabs. The device had an unknown load capacity and had not been load-tested. The synthetic weaved sling holding the load was suspended from the device by use of wrapped steel chain, damaged/twisted bolts, and padlocks. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
