29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: On or about March 30, 2017, during the installation of a water line at approximately 26700 Brookpark Road Extension , North Olmsted, Ohio, the employer did not ensure employees working inside a trench, with a varying depth of approximately 6 to 7.5 feet deep and with near 90 degree vertical walls, were protected from cave-ins by an adequately designed protection system. The soil would have been classified as; Cohesive Soil, type B .

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about March 30, 2017, during the installation of a water line at approximately 26700 Brookpark Road Extension , North Olmsted, Ohio, the employer did not ensure employees a fiberglass type stepladder was extended at least 3 feet above the upper landing surface (ground); or the ladder was secured at its top and a grasping device was provided for employees accessing and egressing from an approximately 7.5 foot deep trench.
